Affirming the district court’s judgment in favor of Central Baptist Church, holding that the insurer, Church Mutual, waived its misrepresentation defense by expressly withdrawing it at trial and failing to object to its exclusion (see Glass v. United of Omaha Life Ins. Co., 33 F.3d 1341, 1347 (11th Cir. 1994)). The Court also upheld the jury’s $1.75 million damages award and prejudgment interest, finding no abuse of discretion in the district court’s denial of the insurer’s Rule 59 motion, as the evidence supported the verdict and the damages did not constitute a double recovery (St. Luke’s Cataract & Laser Inst., P.A. v. Sanderson, 573 F.3d 1186, 1203 (11th Cir. 2009)). https://media.ca11.uscourts.gov/opinions/pub/files/202211082.pdf
